1. General Terms and Conditions

These terms and conditions affect your legal rights. It is important that you read this agreement carefully before making a purchase, booking, or subscription. By signing this agreement physically, or by selecting “I agree to the Terms and Conditions” on our website, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions in this agreement. If you are making a purchase or booking on behalf of another person, you agree that you are acting as their agent so that they will be bound by this agreement.

The Golf Lounge (operating at 1 Broadway, Newmarket, Auckland) as the supplier of premium recreational services including, but not limited to: Indoor golf simulator bay hire, Trackman technology utilization, food and beverage services, and general use of the premises at The Golf Lounge venue. Using the facilities and partaking in activities at The Golf Lounge are done strictly according to the terms and conditions of this agreement.

2. Conditions of Entry

• We will not be liable for any personal injury, property loss, or damage where negligence cannot be directly attributed to us.
• Children under 16 must remain under the supervision of a responsible adult at all times.
• We reserve the right to deny entry or cancel your simulator access immediately if you:
  • Reasonably appear to be intoxicated or under the influence of, or in possession of, illicit substances.
  • Fail to comply with these terms and conditions or fail to follow the direct instructions of The Golf Lounge staff.
  • Behave in an offensive, reckless, careless, disruptive, or threatening manner to other customers, guests, or our staff.
  • Are reasonably believed to be a danger to yourself, others, or your physical surroundings.
  • Service of alcohol is subject to the Sale and Supply of Alcohol Act 2012. The Golf Lounge reserves the right to refuse service to any person.

3. Participation Warning and Acknowledgement

You agree that any sporting, training, or leisure activity conducted at our premises which you participate in—including passive participation (such as observing a player in a simulator bay)—has an inherent risk and may result in personal injury. You assume and accept all associated risks.

Customers acknowledge that golf balls can travel at high speed and must follow all bay safety instructions. Failure to do so may result in immediate termination of the session without refund.

You affirm that you understand the scope, nature, and extent of the risks involved in the indoor golf and recreational activities covered by these terms and conditions. You warrant that you are not under the influence of drugs, alcohol, or medication that may impair your ability to safely swing a club or engage in activities.

You acknowledge that the physical exertion required to swing golf clubs and participate in simulator activities can activate or aggravate pre-existing physical or medical conditions. You represent that you are in good health and free from adverse medical conditions that would make participation unsafe. You should always seek professional medical advice if you are in doubt about your health.

In the event of an accident or injury, you agree to pay the costs of, and authorize The Golf Lounge to take, all steps it considers reasonably necessary to protect your welfare, including the administration of emergency medical treatment and ambulance transportation.

Subject to the provisions in this agreement, you release, discharge, and forever hold harmless The Golf Lounge, its employees, agents, directors, and representatives from all liability, obligation, and responsibility of any nature whatsoever relating to, touching upon, or arising directly or indirectly from your engagement in activities at our Newmarket venue.

4. Bookings, Payments, and Cancellations

Bookings for simulator bays, activities, and services at The Golf Lounge (1 Broadway, Newmarket, Auckland) are subject to the following terms:

• Booking age: The person making the booking must be at least 18 years of age and is responsible for all guests included in the booking.
• Booking Channels: Bookings can be made online via our website booking platform, over the phone, or in person at the venue.
• Third-Party Terms: By booking online, you agree to the terms, conditions, and privacy policies set out by our third-party booking and reservation software provider.
• Accuracy: It is your responsibility to check and confirm the details of your booking (date, time, number of bays). We will not be liable for missed sessions or booking errors if incorrect information is provided by you.
• Confirmation: Your booking will be confirmed via email. This confirmation is binding, and upon receipt, you agree to enter a contract with us.
• Online Payments: Online payments are processed securely. There may be additional transaction fees for card processing; these fees will be made transparent at checkout, and you agree to pay them.
• Cancellations & Changes: Changes and cancellations are permitted up to 1 hour before your scheduled booking time and can be managed directly via your online account dashboard. For emergency changes within 1 hour of your booking, you must contact The Golf Lounge directly by phone.
• Refund Policy: We do not offer refunds or credits for cancellations, “no-shows,” or booking changes made less than 1 hour before the scheduled booking time. No refunds will be given for a change of mind.
• Staff Adjustments: The Golf Lounge staff reserve the right to make operational adjustments to your booking at any time if necessary (including slightly adjusting start/finish times, or shifting your group to an alternative designated simulator bay of equal quality). You will be automatically notified via email regarding any venue-initiated adjustments.

5. General Guidelines

• The Golf Lounge reserves the right to refuse entry to any person whose clothing, footwear, or appearance is deemed unsuitable for the venue or may adversely affect the comfort, safety, or enjoyment of other guests.
• Footwear must be worn at all times. Bare feet, socks-only use, and footwear with metal golf spikes are prohibited.
  Your booking duration and price are shown clearly during checkout and are finalized in your confirmation email.
  All transactions are processed in New Zealand Dollars (NZD) and are inclusive of GST. Fees, bay rates, and hospitality charges shown on our website or within the venue are subject to change without notice.
• You acknowledge that despite our reasonable precautions, services or bay pricing may occasionally be listed incorrectly due to a system error or digital oversight. In these rare instances, we reserve the right to cancel the transaction or adjust the booking to the correct rate, notwithstanding that your booking was confirmed and paid for. We will issue a full refund if an agreement cannot be reached.
• If we encounter unforeseen technical simulator maintenance or operational delays, your booking may be delayed. We will take all necessary steps to ensure your actual total time of simulator use is not reduced.
• The Golf Lounge reserves the right to amend, postpone, cancel or modify any tournament, competition or league format where reasonably necessary.

6. Your Responsibilities & Safety Rules

By entering the venue and participating, you agree to abide by the following strict safety rules, in addition to all verbal and posted staff instructions:

• Hitting Area: Only one active player is permitted inside the designated simulator hitting area at any one time. All other guests must stand completely clear of the swing path.
• Swinging Safety: You must hit golf balls strictly from the provided hitting mats. Running starts, trick shots, or general horseplay are strictly prohibited. You are financially and legally responsible for the safety of those around you and must always physically check your surroundings before swinging a club.
• Aim: Aim to hit the projector screen directly. Intentionally hitting walls, ceilings, side netting, or tracking technology is a breach of safety terms.
• Equipment: You must only hit one golf ball at a time. Ensure balls are clean and free of markings before hitting them into the screens.
• Media Use: Photographs and videos taken within our premises are for personal and social media use only, and must not be used for commercial production or third-party business sponsorship without our express written consent.
• Financial Liability: You are financially responsible for any damage caused to Trackman radar units, projectors, screens, enclosures, clubs, or facility property due to reckless behavior or failure to follow rules. Any damage to property will result in you being billed for the full professional repair and/or replacement costs.
• Personal Property: You are solely responsible for your own golf clubs and personal belongings. The Golf Lounge will not be responsible or liable for any loss, theft, or damage to guest property.
• Smoke-Free Facility: Smoking, vaping, and the use of e-cigarettes are strictly illegal and prohibited anywhere inside the building.

7. Marketing Consent & Media

You acknowledge and agree that upon entering 1 Broadway, Newmarket, you may be captured on camera or video for security, safety, and operational purposes.

We may use photographs and video taken in public areas of the venue for promotional purposes. If you do not wish to appear in marketing material, please advise a staff member.

8. Hyperlinks & Third-Party Sites

Our website may contain hyperlinks to external sites operated by third parties (such as booking platforms, tournament software, or catering partners). These websites are not controlled by us. By using those links, you acknowledge that we are not responsible for the contents, privacy practices, or security of any hyperlinked external website. You access them entirely at your own risk.

9. Legal Rights and Remedies

Notwithstanding any other provisions of these terms and conditions, nothing in these terms is intended to negatively affect, restrict, or exclude the legal rights and remedies available to you under the New Zealand Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986 (FTA).

⚠️ Business/Trade Exception: If you are accessing our venue, booking corporate events, using our website, or engaging in our recreational simulator activities explicitly for business/trade purposes or corporate commercial entertainment, you agree that the consumer protections and relevant provisions of the CGA and FTA will not apply to our commercial transaction.
